Lasting Power of Attorney
A lasting power of attorney (LPA) gives a person or persons of your choice the legal power to deal with your assets and to make decisions about your personal circumstances on your behalf during your lifetime. It is put in place in advance so that your family and/or friends can take over your affairs as easily as possible. LPA’s replaced enduring powers of attorney (EPA) as of 1st October 2007 but any valid EPA in existence at that date will continue to be valid. Attorneys acting under a valid EPA have a duty to register the EPA in certain circumstances.

Court of Protection
The Court of Protection is part of the office of the Public Guardian and was set up under the Mental Capacity Act 2005 to make decisions regarding the property, affairs, healthcare and personal welfare of people who lack mental capacity and do not have a valid EPA or LPA in place.
